These Terms & Conditions (the ”Terms”) govern your access to and use of the Puerta 43 website at www.puerta43.com (the “Site”), as well as enquiries and purchases arising from the Objects presented on the Site.
The Site does not offer online checkout. Purchases are concluded directly with Puerta 43 in accordance with the process described below.
By accessing or using the Site, you agree to these Terms. Where a purchase is made, the signed Quotation and these Terms together constitute the Contract of Sale.

2. ABOUT PUERTA 43
Puerta 43 is a curatorial studio dedicated to presenting collectible objects by artists and makers.
Its selection may include unique works, limited editions, made-to-order Objects and pieces commissioned or developed in collaboration with artists, designers and craftspeople.
The Site is intended to introduce these Objects and facilitate direct enquiries regarding their acquisition.
3. USE OF THE SITE
The site may be accessed and used for personal and lawful purposes only.
You must not misuse the Site, interfere with its operation, attempt to gain unauthorised access to it, introduce malicious software or use any Site content in an unlawful manner.
Puerta 43 may modify, suspend or discontinue any part of the Site without prior notice.
4. OBJECTS, PRESENTATION & AVAILABILITY
Puerta 43 makes every reasonable effort to present each Object accurately through its descriptions, dimensions and photography.
Colours, textures and finishes may nevertheless appear differently depending on screen settings, lighting conditions and photographic reproduction.
Many Objects are handmade, produced in small editions or entirely unique. Variations in colour, texture, dimensions, grain, glaze, patina or other characteristics may be inherent to the materials and making process. Such variations contribute to the individuality of each Object and are not considered defects.
All Objects are subject to availability and may be withdrawn or sold without prior notice.
The presentation of an Object on the Site does not constitute a binding offer for sale.
5. ENQUIRIES & PURCHASES
Puerta 43 does not currently offer online purchasing or checkout through the Site.

Following an enquiry, Puerta 43 will issue a Quotation setting out:
the Object(s) to be purchased, including their description and specifications;
the purchase price;
shipping costs;
the estimated dispatch and delivery timeline;
shipping arrangements;
payment terms; and
any other conditions specific to the purchase.
The Quotation will state its period of validity. Until the Quotation has been signed and returned by the purchaser, the availability of the Object(s) and the purchase price remain subject to change.
To proceed with the purchase, the purchaser must sign and return the Quotation to Puerta 43.
Upon receipt by Puerta 43 of the signed Quotation, the Quotation and these Terms shall together constitute the Contract of Sale between Puerta 43 and the purchaser for the purchase of the Object(s).
The purchaser shall make payment in accordance with the terms set out in the Quotation.
A final invoice will be issued following dispatch and will include the relevant shipping details.
6. PRICES, TAXES & IMPORT CHARGES
Unless otherwise stated, prices are expressed in Euros (€).
The applicable purchase price, the treatment of VAT and the shipping costs will be specified in the Quotation.
Prices displayed on the Site are indicative and may be changed without prior notice. The price applicable to a purchase is the price stated in the signed Quotation.
Any customs duties, import taxes, customs-clearance charges, brokerage fees or other charges imposed in the country of destination are not included in the purchase price or shipping costs and are the sole responsibility of the purchaser.
The purchaser is responsible for obtaining any information required regarding the importation of the Object(s) into the destination country.
7. PAYMENT
Payment instructions will be provided in the Quotation.
Unless otherwise stated in the Quotation, payment shall be made by bank transfer in accordance with the terms specified therein.
The purchaser shall bear any bank charges, transfer fees or currency-conversion costs imposed by the purchaser’s bank or payment provider. Such charges must not reduce the amount payable to Puerta 43.
Puerta 43 must receive the full amount stated in the Quotation.
Ownership of the Object(s) shall transfer to the purchaser only once Puerta 43 has received the full amount due.
The order will be prepared for dispatch once full payment has been received.
8. SHIPPING & DELIVERY
The shipping arrangements and delivery dates are provided in good faith but remain approximate.
Puerta 43 is not responsible for delays caused by carriers, customs procedures or circumstances beyond its reasonable control.
Puerta 43 will arrange the shipment through a suitable carrier and insure the Object(s) for their purchase price during transit.
The risk of loss or damage to the Object(s) remains with Puerta 43 until delivery to the purchaser or to a third party designated by the purchaser. Upon delivery, that risk passes to the purchaser.
This means that Puerta 43 will manage any claim relating to loss or damage occurring during transit. The transfer of risk upon physical delivery is also the standard rule applicable to EU consumer sales.
9. WITHDRAWAL & RETURNS
9.1 Statutory right of withdrawal
Where the purchaser qualifies as a consumer and benefits from a statutory right of withdrawal under applicable law, the purchaser may withdraw from the Contract of Sale within fourteen (14) days of taking physical possession of the Object(s).
To exercise this right, the purchaser must notify Puerta 43 by email at arte@puerta43.com before the applicable withdrawal period expires.
The purchaser must return the Object(s) without undue delay, in accordance with the return instructions provided by Puerta 43.
The Object(s) must be returned unused, undamaged and, wherever reasonably possible, in their original packaging, together with any Certificate of Authenticity, documentation and accompanying elements.
Before returning the Object(s), the purchaser must carefully document their condition by taking photographs of the Object(s) before packaging, during the packaging process and once the package has been sealed. This documentation may be required by Puerta 43, the carrier or the insurer in connection with any claim relating to the return shipment.
No refund will be processed until the returned Object(s) have been received and inspected by Puerta 43. Where permitted by applicable law, Puerta 43 reserves the right to reduce or refuse a refund if the returned Object(s) are found to be damaged, incomplete or handled beyond what is necessary to establish their nature, characteristics and condition.
The purchaser shall bear all return shipping and insurance costs, and any related charges.
9.2 Exceptions
The statutory right of withdrawal does not apply to commissioned, made-to-order, personalised or otherwise bespoke Object(s) produced according to the purchaser’s specifications, or in any other circumstances excluded by applicable law.
9.3 Returns outside a Statutory Right of Withdrawal
Where no statutory right of withdrawal applies, returns are not accepted unless expressly authorised in writing by Puerta 43.
Where a return is exceptionally authorised by Puerta 43, all return shipping costs, insurance costs, customs duties and any other related charges shall be borne by the purchaser.
The purchaser must not return any Object(s) without first obtaining written return instructions from Puerta 43.
10. DAMAGED ITEMS
Each Object is carefully inspected before dispatch and packaged with the utmost care.
Prior to dispatch, Puerta 43 documents the condition of each Object by taking photographs before packaging, during the packaging process and once the package has been sealed. This documentation may by used to assess any claim relating to damage in transit.
If an Object is delivered damaged, the purchaser must notify Puerta 43 by email at arte@puerta43.com within forty-eight (48) hours of delivery.
The notification must include:
photographs of the damaged Object(s);
photographs of the packaging;
a description of the damage; and
any other information reasonably requested by Puerta 43, the carrier or the insurer.
The purchaser must retain the Object(s), all packaging materials and any accompanying documentation until instructed otherwise by Puerta 43. No Object(s) may be returned, repaired or disposed of without the prior written consent of Puerta 43.
Puerta 43 will handle the claim with the carrier or insurer and will keep the purchaser informed throughout the process.
Where appropriate, Puerta 43 will determine the most suitable solution, which may include repair, replacement, reimbursement or any other appropriate remedy, depending on the nature of the damage, the circumstances of the claim and the availability of
an appropriate solution.
11. COMMISSIONED & MADE-TO-ORDER OBJECTS
Puerta 43 may offer certain Objects on a made-to-order or commissioned basis.
Made-to-order Objects
Made-to-order Objects are existing designs produced specifically upon request.
The relevant Quotation will specify the Object(s), their specifications, the estimated production and delivery timeline, the purchase price and the applicable payment terms.
Production will commence only upon receipt of the signed Quotation and payment in accordance with the agreed terms.
Commissioned Objects
Commissioned Objects are developed specifically for a purchaser and may involve discussions regarding the design, materials, dimensions, finishes or other specifications.
The scope of the commission, estimated production timeline, purchase price, payment terms and any specific conditions applicable to the commission shall be set out in the relevant Quotation.
Production will commence only upon receipt of the signed Quotation and payment in accordance with the agreed terms.
General
Once production has commenced, made-to-order and commissioned Objects may not be cancelled, modified or returned.
Estimated production and delivery timelines are provided in good faith but remain approximate.
12. AUTHENTICITY & DOCUMENTATION
Puerta 43 guarantees that every Object offered for sale through the Site and Quotation is authentic.
Where applicable, an Object may be accompanied by a Certificate of Authenticity, edition number, care instructions or other documentation issued by Puerta 43 or by the relevant artist or maker.
Such documentation forms an integral part of the Object and should be carefully retained by the purchaser.
Request for replacement documentation will be considered on a case-by-case basis and cannot be guaranteed.
13. INTELLECTUAL PROPERTY
All content published on the Site, including but not limited to text, photographs, images, graphics, logos, visual identity, website design and other materials, is protected by applicable intellectual property laws.
Unless otherwise stated, such content is owned by Puerta 43 or is used with the permission of the relevant rights holder.
The intellectual property rights relating to the Objects presented on the Site remain the exclusive property of the respective artists, makers or other rights holders, unless expressly agreed otherwise in writing.
The purchase of an Object does not transfer or licence any intellectual property rights relating to that Object.
No content from the Site may be copied, reproduced, published, distributed, modified, transmitted or otherwise used, in whole or in part, without the prior written consent of Puerta 43.
14. EXTERNAL LINKS
The Site may contain links to third-party websites for informational purposes only.
Puerta 43 has no control over, and accepts no responsibility for, the content, availability or privacy practices of such third-pary websites.
Access to any third-party website is entirely at the user’s own risk.
15. LIMITATION OF LIABILITY
Puerta 43 makes every reasonable effort to ensure that the information published on the Site is accurate and up to date.
However, Puerta 43 does not warrant that the Site will always be free from errors, interruptions or omissions.
To the fullest extent permitted by applicable law, Puerta 43 shall not be liable for any indirect, consequential or special loss arising from the use of the Site or from any information contained on the Site .
Nothing in these Terms & Conditions excludes or limits any liability that cannot be excluded or limited under applicable law.
16. PRIVACY
Please refer to our Privacy Policy for information regarding the collection, use and protection of personal data.
17. GOVERNING LAW
These Terms & Conditions and any Contract of Sale between Puerta 43 and the purchaser shall be governed by and construed in accordance with the laws of Spain.
Any dispute arising out of or in connection with these Terms & Conditions or any Contract of Sale shall be submitted to the competent courts of the Balearic Islands (Spain), unless mandatory provisions of applicable law provide otherwise.
Nothing in these Terms shall limit or exclude any rights that cannot legally be excluded under applicable law.
18. CHANGES TO THESE TERMS
Puerta 43 reserves the right to amend these Terms & Conditions at any time.
The version published on the Site at the time of entering into the Contract of Sale shall apply to that purchase.

20. FORCE MAJEURE
Puerta 43 shall not be liable for any delay or failure to perform its obligations where such delay or failure results from events beyond its reasonable control, including, but not limited to, natural disasters, fire, flood, war, terrorism, pandemics, governmental actions, strikes, transport disruptions, supplier delays, or failures of communication networks.
Where a Force Majeure event affects the performance of a Contract of Sale, Puerta 43’s obligations shall be suspended for the duration of the Force Majeure event.
Puerta 43 will keep the purchaser informed of any significant delay and will use reasonable efforts to fulfil its obligations as soon as reasonably practicable.
